It is definitely "unclassified" road, not only because of surface, but mainly do to importance, traffic and character. From official OSM documentation: "Note that some correctly tagged highway=unclassified may have an official number". So, the fact, that this road is officially classified cannot be the only reason to treat it as tertiary.
