Now you've got me curious about this again. I emailed my contact to ask for clarification. (Based on past experience, getting a response could take a while however.) Just to be on the safe side though I will avoid using that imagery in the meantime, till I can get confirmation on this question. Thanks for bringing it up.

Oh yes I'm very aware, and in fact I had this same question initially. (I've been an OSM contributor for a long time). I asked about it at the meeting we had for this project. What I can tell you is the city we're working with does license Nearmap imagery, through the program I mentioned above. As a lowly volunteer I'm not privy to the actual license agreement, so I can't independently verify that it's compatible with OBdL. But I do think that Nearmap offers such a license (seems like the Lyft mapping team is a prominent user of it). So it didn't seem unreasonable to me that our MPO has a similar agreement. Hope this puts you at ease a bit.

Hi! That private tag probably isn’t correct; I just left it from somebody else’s edit. You won’t have any legal concerns biking in that area. I haven’t been in person in a while, but the only possible worry I’d think is that sections of the trail can be muddy or even submerged if it’s been raining a lot. We haven’t had any floods recently though, so unless you’re on a road bike, that whole section should be passable. Enjoy!
