oops, missed that :-) permissive looks like the way to go

Maybe you are right, but I can't find support elsewhere for the idea that access==yes means legal right of way. It just means that any road user is permitted. Meanwhile 'private' definitely seems too restrictive. My info about current conditions in this area comes from people who drive there. Do you have conflicting and/or first hand info?
